By accessing or using our website, submitting information to TalentPop, applying for a role, communicating with our team, or opting in to receive SMS/text messages from TalentPop, you agree to these Terms & Conditions.

If you do not agree to these Terms & Conditions, please do not use our website, submit forms, apply through our recruiting process, or opt in to receive SMS/text messages from TalentPop.

1. About TalentPop

TalentPop provides hiring, recruiting, staffing, customer experience, operational support, and related business services for E-Commerce and other companies. TalentPop may also communicate with candidates, applicants, prospective team members, contractors, clients, partners, and website visitors through our website, email, phone, SMS/text messaging, applicant tracking systems, and other communication channels.

These Terms & Conditions apply to general website use, TalentPop content, candidate communications, and SMS/text messaging unless a separate written agreement applies.

2. Use of Our Website and Content

The TalentPop website and all related content, including text, graphics, logos, videos, service descriptions, resources, forms, images, downloadable materials, and other information, are provided for general informational and business purposes.

You agree to use the website and content only for lawful purposes and in accordance with these Terms & Conditions. You may not:

  • Copy, reproduce, republish, distribute, sell, or commercially exploit our website or content without our written permission.
  • Use automated tools, bots, scrapers, crawlers, or similar technologies to access, monitor, extract, or copy website content without authorization.
  • Attempt to interfere with the security, performance, or functionality of the website.
  • Use the website or content in a way that violates any law, regulation, third-party right, or TalentPop policy.
  • Misrepresent your identity, affiliation, employment history, qualifications, or other information submitted to TalentPop.
  • Upload or submit malicious code, unlawful content, false information, or content that infringes the rights of others.

TalentPop may restrict, suspend, or terminate access to the website or any related content at any time and for any reason.

3. No Guarantee of Employment, Engagement, or Services

Submitting an application, form, inquiry, resume, phone number, email address, or other information to TalentPop does not guarantee employment, contract work, placement, interview availability, client engagement, or any specific outcome.

TalentPop may review candidate information, contact candidates, conduct interviews, assess qualifications, and determine eligibility for opportunities at its discretion. TalentPop may also decline to move forward with an applicant, candidate, client, or partner at any time, subject to applicable law and any written agreement that may apply.

4. Candidate and Applicant Information

If you apply for a role, submit a recruiting form, provide your resume, or otherwise share candidate information with TalentPop, you agree that the information you provide is accurate, current, and complete to the best of your knowledge.

TalentPop may use candidate and applicant information for recruiting, hiring, interview coordination, assessment, candidate management, compliance, operational, and related business purposes. Candidate communications and information may be stored in TalentPop’s applicant tracking system or recruiting tools, including Ashby, and may be reviewed by authorized TalentPop team members involved in recruiting, hiring, operations, or compliance.

You are responsible for ensuring that the contact information you provide is accurate and that you have the right to provide it.

5. Personal Information and Privacy

TalentPop collects, uses, stores, and shares personal information in accordance with our Privacy Policy.

By using our website, submitting information to TalentPop, applying for a role, or communicating with our team, you acknowledge that TalentPop may process your information as described in our Privacy Policy.

6. Account Access and Security

If TalentPop provides you with access to any portal, platform, candidate account, client account, training system, or other protected resource, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree not to share your access credentials with unauthorized parties or use another person’s credentials without permission. You must notify TalentPop promptly if you believe your account or access credentials have been compromised.

TalentPop is not responsible for unauthorized access resulting from your failure to protect your login credentials.

7. SMS/Text Messaging Terms

This section applies to SMS/text messages sent by or on behalf of TalentPop, including recruiting, hiring, candidate communication, application updates, interview coordination, and related employment opportunity messages.

7.1 SMS Program Description

TalentPop may send SMS/text messages to candidates, applicants, leads, prospective team members, contractors, or other individuals who have opted in to receive text communications from TalentPop.

Messages may include, but are not limited to:

  • Application updates
  • Interview scheduling or reminders
  • Follow-ups from TalentPop’s recruiting team
  • Hiring process updates
  • Requests for additional candidate information
  • Job opportunity updates related to TalentPop or roles you applied for or expressed interest in
  • Recruiting event information
  • Candidate onboarding or next-step instructions
  • Other recruiting, hiring, or candidate support communications

TalentPop does not use this SMS program to send unrelated third-party marketing messages.

7.2 Consent to Receive Text Messages

By submitting your mobile phone number through a TalentPop application form, candidate form, recruiting form, website form, or by otherwise providing your phone number and opting in to receive text messages, you consent to receive SMS/text messages from TalentPop at the mobile number you provided.

Consent to receive SMS/text messages is not a condition of applying for a role, being considered for employment, being hired, or purchasing any services from TalentPop.

You represent that you are the account holder or authorized user of the mobile phone number provided.

7.3 Message Frequency

Message frequency may vary depending on your application status, hiring stage, role interest, interview schedule, recruiting activity, onboarding needs, and communication preferences.

You may receive multiple messages during an active recruiting or onboarding process, and fewer or no messages when there is no active application, interview, hiring-related update, or relevant communication need.

7.4 Message and Data Rates

Message and data rates may apply. Your mobile carrier may charge you for sending or receiving text messages based on your wireless plan.

TalentPop is not responsible for any messaging, data, or other charges from your mobile carrier.

7.5 How to Opt Out

You may opt out of receiving SMS/text messages from TalentPop at any time by replying STOP to any text message you receive from TalentPop.

After you reply STOP, TalentPop may send you a confirmation message and will stop sending SMS/text messages to that mobile number unless you later opt in again.

Opting out of SMS/text messages does not prevent TalentPop from contacting you through other communication channels, such as email or phone, where permitted.

7.7 Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Text message delivery may be affected by factors outside TalentPop’s control, including mobile carrier availability, network coverage, device limitations, technical issues, or other circumstances.

7.8 Supported Carriers

TalentPop’s SMS/text messaging program may not be available on all mobile carriers or in all locations. Message delivery is subject to your mobile carrier’s network availability and terms.

7.9 SMS Privacy

TalentPop respects your privacy. Information collected through SMS/text messaging will be handled in accordance with TalentPop’s Privacy Policy.

TalentPop will not sell or share SMS opt-in consent information with third parties for their own marketing purposes. SMS consent and phone numbers collected for SMS purposes will not be shared with third parties or affiliates for their own marketing purposes.

8. Third-Party Websites, Platforms, and Tools

TalentPop’s website, forms, recruiting process, communications, or services may include links to or integrations with third-party websites, platforms, tools, or services, including applicant tracking systems, calendar tools, video meeting platforms, analytics providers, payment processors, job boards, and other technology providers.

TalentPop does not control and is not responsible for third-party websites, platforms, tools, content, privacy practices, security practices, terms, or services. Your use of third-party platforms may be governed by their own terms and policies.

9. Intellectual Property

The TalentPop name, logos, trademarks, service names, website content, materials, graphics, designs, resources, processes, documents, and other content are owned by TalentPop or its licensors and are protected by applicable intellectual property laws.

You may not use TalentPop’s name, logos, trademarks, or materials without prior written permission, except as permitted by law.

Nothing in these Terms & Conditions grants you ownership rights in TalentPop’s website, content, services, trademarks, or intellectual property.

10. User Submissions

If you submit information, feedback, suggestions, testimonials, comments, files, resumes, application materials, or other content to TalentPop, you grant TalentPop the right to use, review, store, process, and display that content as reasonably necessary for recruiting, hiring, business operations, service delivery, website administration, communication, compliance, or other legitimate business purposes, subject to our Privacy Policy and applicable law.

You are responsible for ensuring that any content you submit is accurate and that you have the right to submit it.

11. Prohibited Conduct

You agree not to use TalentPop’s website, forms, services, communications, or systems to:

  • Violate any applicable law or regulation.
  • Submit false, misleading, fraudulent, or incomplete information.
  • Harass, abuse, threaten, or harm TalentPop employees, contractors, candidates, clients, partners, or other users.
  • Attempt to gain unauthorized access to TalentPop systems, data, accounts, or networks.
  • Interfere with website functionality, security, or availability.
  • Transmit viruses, malware, spam, or other harmful content.
  • Infringe or misappropriate the intellectual property, privacy, or other rights of others.

13. Limitation of Liability

To the fullest extent permitted by law, TalentPop and its affiliates, owners, officers, directors, employees, contractors, agents, partners, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages arising out of or related to your use of the website, content, forms, services, communications, recruiting process, or SMS/text messaging program.

This includes, but is not limited to, damages related to lost profits, lost opportunities, lost data, business interruption, delayed messages, undelivered messages, website errors, third-party platforms, or unauthorized access, even if TalentPop has been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless TalentPop and its affiliates, owners, officers, directors, employees, contractors, agents, partners, service providers, and representatives from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the website, content, forms, communications, or services.
  • Your violation of these Terms & Conditions.
  • Your violation of any law, regulation, or third-party right.
  • Information or content you submit to TalentPop.
  • Your misuse of TalentPop’s website, systems, content, or communications.

Your continued use of TalentPop’s website, content, forms, communications, services, or SMS/text messaging program after updates are posted means you accept the updated Terms & Conditions.

TalentPop may suspend, restrict, or terminate access to the website, content, forms, communications, services, or systems at any time and for any reason, including if TalentPop believes you have violated these Terms & Conditions or applicable law.

TalentPop’s failure to enforce any provision of these Terms & Conditions does not waive TalentPop’s right to enforce that provision later.

You may not assign or transfer your rights or obligations under these Terms & Conditions without TalentPop’s prior written consent. TalentPop may assign these Terms & Conditions as part of a merger, acquisition, restructuring, sale of assets, or other business transaction.
